Can I apply for a tourist visa before my humanitarian visa expires?

Hello, I've recently resigned from my current ESL teaching position to transfer to a new company. However, my current employer has refused to give me a release and cancellation certificate/letter, and given me no choice but to cancel my residence permit, while only giving me a 3 day humanitarian visa instead of the full 30 days, when I receive my passport back from the exit and entry office. So I'm wondering if my situation is a futile one and I have to leave the country, or if it's possible for me to extend my stay via a tourist visa so my new company has time to sort out my new work visa without me having to leave the country?

Once you have been issued an exit visa, you need to exit China during it's validity. If you stay past the visa's validity period then it would be considered overstaying. So if you haven't done so, you need to leave China ASAP to any country to which you don't require a visa, otherwise it would cause headaches in the future of you want to continue working in China.

Also reports from earlier this year indicate that one cannot get a Z visa in HK if they have been issued an exit visa (however in that particular case the person who was also relocating for work received a visa that didn't have a category but only an asterisk, so it can also be possible that Shanghai immigration screwed up the paperwork).
