Inquiry Regarding S1 Visa Application for Daughter with Upcoming Contract Renewal

My wife and I are currently working in China, and our daughter was born here. Our current work contract is set to expire in February 2025, which is less than 180 days away. I visited the visa office to apply for a visa for our daughter, but they informed me that we could only apply for an S1 visa, rather than an S2 visa, due to the expiration of our current contract within 180 days.

However, I will be receiving a new job contract following the expiration of this one. My question is whether I can obtain an S1 visa for my daughter without exiting China, or if I will need to leave the country to apply for it.

I think you need to get a S1 in your home country for her. Because before you receive your new job, you need to cancel your present work permit and visa at the exit and entry administration and after the cancellation, a stay visa with a duration of 30 day will be given to you for job changing or leaving, during which the S1 visa of your daughter based on your work residence in China may also become invalid. I haven't seen a case like this, so it's advised to consult the local exit and entry administration, maybe there is another resolution.
