About:Overstaying in China & Penalty

Penalty days counting

We were stopped by an officer on the day that our visa expired (unknowingly) and he let us go, with a note to go to the PSB next day. We did and they told us to apply for a visa extension. So I guess we overstayed. The question is how they count days. Is one day, or from the expiry until we receive the new extended visa? I guess we have to pay the fine when we pickup our passports again from PSB.

What kind of visa do you have? If it's L, M or F then visa expiration does not affect your status in Mainland China, as you are authorized to stay whatever days that is indicated on your visa once you have entered, even when the visa will be expiring during that period.

It's a simple 30 day tourist visa.

Yes, by accident, but we applied for an extension, got a warning not a fine from the police. They seems to count from the visa ending until the day when you applied for a new visa. We applied the day after the visa ended and hence we 'overstayed' for one day.
