About:How to Apply for a China Visa

about overstaying visa in china and having an expired passport

Hi, i has been overstayed in china for three years and i really wanted to go back home. I have 5000 rmb to pay the fine and for the plane ticket. How long does it take to get an exit permit if my passport is expired?Please i need your advice. I am willing to surrender in Shanghai immigration soon.

Since your passport is expired, you need to renew your passport first. Then you can go to the local Exit-Entry Adminstration Bureau to pay the fine and get a exit permit. The exit permit is issued immediately after you apply at the bureau, but the time to get your passport renewing is hard to tell and it depends on your country's embassy.

BTW, 5000RMB may not be enough for you to pay the fine, because you have been overstayed for three years.

so how much fine do you should be enough to clear the penalty? and is it possible you can come back to china with a different type of visa?

Overstaying for three years is way too long. Under the new law, you will be detained first while the police verifies your identity. If they determine you are working illegally in China, the fine will increase to 20,000 yuan. They will also contact your country's embassy for a travel document. You may be detained for up to fifteen days. There is also a ten-year ban so you won't be issued any visa for China. Overall, 5,000 yuan is not even close to the fines and tickets combined.
