About:Overstaying in China & Penalty

Unintentionally overstaying for 1 day

Hello, I unintentionally overstayed my visa for 1 day during Chinese new year holiday. They told me that it was an offense against Chinese law, and they took my fingerprints.

I didn't pay anything and I went to get a new visa the next day.

I am now applying for student visa in Canada, will it appears on my criminal record ?

Since you overstayed only for one day normally it won't be a back record so you can apply for a student visa as normal.

I think people will understand if you explained it was an accident. Do you have records of the incident? I believe that may help. Knowing our police they might have confiscated any such documents from you or refused to provide further explanation but it's a rather safe bet that it would be of help.

I'm not sure but it seems that our border control isn't very friendly and it does constitute a criminal offence. I have no idea what the Canadian government would make of this situation though. Since they give periods of leniency that extend up to 90 days from cases I've seen, as opposed to a visa immediately becoming invalid regardless of the amount of times of entry to the country, I would imagine they could cut some slack. And I do recall Canadians being some of the most polite people around, so I'm sure they could make things work.
