My brother got caught by policemen working illegally............

Hi i am a filipino band vocalist here in beijing. I just would like to ask some question if i may...

I have a brother who is working as a teacher in Shenyang for a year now. My boss hired my him in the Philippines not as a band but as a teacher with an entertainment visa and told us to not worry about it because there will be no problem.

Last December 11 he got caught by policemen at school but he doesn't have his passport with him because our boss is the one is keeping our passports (this is one of his rules for those who want to apply under his company). The police told my brother to pay fine ( 5,000 yuan ) and got jailed but my brother has no money and also don't have passport that time he got caught. The policeman said that he will be jailed for 5 days if he will pay the fine.

The boss went to the police station with my brothers passport and paid the fine but my brother was already brought to jail and the boss got no chance to see my brother because the police said it is not allowed. Now it's been 8 days already since my brother got jailed, my question is how long can he possibly be jailed? Is there any possible that my boss got punished for hiring my brother? What's the best thing to do so my brother can be sent back to Philippines as soon as possible? Hoping for an answer. Thank you so much!

I think your brother will be released soon as long as the boss paid the fine. Of course, your boss will get punished for hiring your brother. After your brother is released, he needs to pay to get an exit visa and flight ticket in order to get back home.

Working unlawfully can result in detention for up to 15 days. If it has been 15 days already but your brother is still in jail then you should contact the Philippine embassy.
