Q1 visa question

I’m a Costa Rica citizen living in USA, I have work permit. I married to a Chinese citizen in the US, she has family in China. Would I need to go back to Costa Rica to apply for Q1 Chinese visa or can I do this from the US? Is our marriage in the US valid to apply for Q1 visa? We would like to stay in China for an extended period of time, I understand the Q1 visa can be issued for up to 5 years, in what conditions could I get a Q1 visa for 5 years? We also have a child born in the US we would like to bring to China with us.

You can apply for the Q1 visa in the US. In order to make your marriage valid to apply for the Q1 visa, you need to have your marriage certificate notarized and authenticated in the US. Usually, the Q1 visa allows you to stay in China for 30 days, within this time you need to get a temporary residence permit, which may allow you to stay in China for one to five years, depending on the immigration officer's decision.
