About:Adopt Chinese Children

Adopting from a friend in China

We have a friend in China who would like to give her baby up for adoption. We have known her for many years, and she asked us if we would be interested in adopting the baby. Do all the regular rules still apply if we know the mother and she chose us? We live in the US. My husband is 29, and I am 28. We have been married for 6 years. We have one biological child but have fertility issues (have been trying to get pregnant again for 2 1/2 years).

Amy, I am afraid that you can't do this. You already have a kid. According to related rules, you can't adopt Chinese kids any more. Meanwhile, it's illegal to adopt kids privately. All foreigners who meet the requirements are required to adopt kids via qualified organizations.

Yes, even the parents want their kids to be adopted, they have to prove that they are unable to raise her baby. Then they need to send their baby to the orphanage. Then qualified foriengers can adopt their children. However, you are disqualified because you already have a kid.

I would look further into this. I am currently in the process of adopting from China and have a 5 yo bio child.

"Orphans, disabled children or abandoned infants may be adopted irrespective of the restrictions that the adopter shall be childless."

People with other children frequently adopt children from China who fit into one of these categories, unfortunately your friend's child would not meet the criteria to be adopted by you.
