Q1 visa question need help

Hi,
my girlfriend is chinese .. and 1 year ago we have a baby , but we are not married...
the birth certificate show booth name ..
now i have a F .. can i aaply for a q1 ?
is not easy now for married because of application document and location ..
can anyboday hwlp on this ?
