The penalty for detention because of divorce

My brother is married to a Chinese and around 30th December they got divorced and now they want to re-marry again and he has been detained for 10days soo now what is his punishment because we don’t want him to go back if he go back home some people are planning to kill him

You mean he was detained by Chinese police because he divorced with his Chinese wife and then overstayed in China without a legal residency? His case is too special. I think he needs the new legal residency to get re-married but before that, he would be given the exit permit and deported. It's advised to consult the local exit and entry administration.
