I'm afraid Borut's assessment might be partially erroneous. I personally had a just-over-three-hour layover late into the night once and the immigration official did offer me the option of granting the temporary entry permit, so I'm not sure where the eight-hour cutoff rule comes from. True, I don't think you can do much with such a short amount of time other than exiting the airport to breathe some air, but still. Nevertheless, I agree that it is at the discretion of the airport immigration official on the day of transit.
So, unless a law has been promulgated after my own transit experience, which is now enforced nationwide regarding an eight-hour cutoff rule for the issuing of temporary entry permits under the 24-hour TWOV, then it is pretty much at the discretion of the official and not a right as stated in the post above.
