About:Dual Nationality

Is there a law that says that 2.5 years required residency for baby born in the US to Chinese mother

I married a Chinese woman and we had a baby in the US. She says that the baby needs to live for 2.5 years or 30 months in China before he turns 5 or he will not be able to get Chinese citizenship. I have not been able to find this anywhere online or otherwise. Everything I find says that it is granted at brith through blood since she is Chinese citizen still.

In fact, there is no such a law to say that the baby needs 2.5 years required residency. And you are right, it is granted at Chinese citizenship since the mother is Chines citizen. However, China doesn't admit dual nationality. If the baby has American citizenship already, then he will lose the Chinese citizenship automatically.
