The urgent thing is to report your case to the exit and entry administration of the local PSB. I think you may be required to pay the fine which is about CNY500 per day with a cap of CNY10,000. I don’t think you will be detained. Don’t worry! Just do it as soon as possible.

Dear Jane, because it is getting longer, you should report it quickly. If you don’t do it now, you may be faced with more serious penalty in the future. As far as I know, you have to pay the fine, as for the detain, it depends. If you explain all the situation and be sincere, it may be not that serious.

Jane,
There is an agent in Guangzhou who processed our 4 years overstay. No long interrogation and most importantly no detention.Just more or less 3 weeks wait and you can go back home safely.

My friend is facing the problem of about 7 months overstayed unknowingly, though he has visa on his passport but immigration told his company already cancelled his visa 7 months ago after he quit the job. Now he shocked and panic. He needs to solve this problem as soon as possible as he already established new trading company here in China before knowing this overstayed problem and also got work permit card from Guangzhou through his own new company. How to solve this problem without any deportation? Your answer will be much appreciated.

Your friend should report the situation to the local police and then pay the fine. Afterwards, apply for an exit pass to leave China. Or he can inquire the officers that if there is any way for him to stay in China after paying the fine. Good luck!

I only know that the capped amount won't exceed CNY10,000.
