what would be penalties

a friend of mine  detained now on china due to not carrying passport, as company hold his passport...what would be the penalty ,and how long it takes the processing, pls help

If he has not overstayed and lived in China legally, I don't think he needs to pay penalties. I'm wondering why the company keeps his passport, but I think if the company is willing to help him, he will be released soon.
