Overstayed for 8 years, help

Hello,

My relative overstayed due to lack of funds. What's the penalty for a overstayed visa for 8 years? Is there a way to not get blacklisted? Maybe i helped renew the passport and get a new visa?

Michael, the penalty is around CNY 10,000. What's more, your relative may be detained for a few days. I think the person would be added onto the black list because the situation is serious. You can help him or her to get a new passport and then apply for an exit pass.

Would the Chinese government know how long my relative has been in China if he tried to exit using a new passport and visa? Can he pretend that they forgot to give him am entry stamp?

How could he get a new visa within China? It's impossible if he has overstayed for a long time. He had better be honest, otherwise the consequences may get worse.

I can take his new passport and get a visa in america then ship it back to him. We don't have the funds available to pay the huge penalty.

It's too risky to do so. First, I don't know whether you can get him a visa outside China. If the embassy finds out he is in China now, he will bear the probable bad results. Second, even though you can get it for him, there will be no entry stamp on his new passport. Do you think the immigration officer will think they have forgot to stamp on the passport? I don't thnk so.

So it sounds like its too risky to try to get a new visa. If I were to tell him to turn himself in should I at least help him renew his old passport before doing so? Would the american embassy care that he doesn't have an exit stamp on his expired airport when I'm renewing it?
