Overstayed 'duration of each stay'

Hi, I have been in China since Nov12th 2014 on a Q2 6 month spouse visa (my wife is Chinese) with 'duration of each stay' set at 60 days. However, I have overstayed this duration now for 4 days today.

Is this treated the same as overstaying your total limit or is it less severe? Is there a way I can get an extension of this within China or do I still need to go to HK?

In fact I have just been waiting to receive an invitation letter and work permit from an employer so I can go to HK and then change my visa to a Z type. It just seems crazy to go to HK... exit and re-enter... then go back again a month later (when the employer says they will have the invitation letter and work permit ready) and do it all again! I wouldn't mind so much if I was in GZ but I am in Hubei :/

Please can anybody offer any advice? ...and thank you for your great site!

Martin :)

Hey, I think you should have a multiple-entry Q2 type, right? If so, you should exit mainland China as soon as possible. I think you will be fined for overstaying four days. But I am not sure if your Q2 type will be cancelled due to your overystaying. If so, you may stay in HK and ask if your employer can send the required documents to you by mail. Then you may try to apply for the Z type. Honestly, I am not sure if you will get the Z type successfully. You know, you have overstayed and it might affect your application for the Z type.

Thank you Jack for the quick response! Well we are going to talk to the police in 2 days to see what they say. I'll update on here what happened so people can see in the future. Unless I'm in jail!

Hey, you are very lucky. They didn't ask you to pay the fine. So you received your Z type without leaving? It seems that policies have changed. Previously, foreigners are required to apply for Z types outside of China because it's not allowed to change visa types in mainland China no matter what type they held.

By the way, did you change your Z type to a resident permit?
