can i apply tourist visa if not complete contract with empoyee on residence permit

I recently had a dispute with an unscrupulous boss at my school in China..The end result being that I left China without my permit being rescinded. I still have 2 months left on my residence permit and wish to apply for a tourist L when the residence permit expires. Is this possible or am I banned from China for 5 years as my ex boss states ?
