Leaving apartment in China

My wife's father died and he did not have a will. My understanding is that under such circumstances normally the surviving wife gets 50% and the surviving children get 50%. My wife's mother does not want the apartment. The family wants the apartment to go to my wife's brother. Can you tell me what paperwork we need to send you in order that we can make this happen?

So, your wife means to disclaim the heritage of this apartment. As I know, she should get a certificate from your local notary office and get it authenticated by Chinese embassy or consulate in US.
