About:Overstaying in China & Penalty

Husband visa expered 6months back

My husband is being detained in china for over staying there,his Visa expered just 6months back,how long does it take him to be deported?

If he worked illegally and was not charged under the penal code, then it's between 15 and 30 days' detention and he will be allowed to leave after his fines are paid (between 10,000 and 30,000 CNY). If he didn't (which is unlikely) then it's a maximum of 15 days OR a 10,000 CNY fine. Keep in mind that periods for investigating his claim will usually not count towards the 15 or 30-day period.

If he was charged by police of a penal code offense (e.g., assault or trafficking) then don't expect him to get out until at least a few years later. Foreigners will languish in Chinese jails for a considerably long time.
