About:Dual Nationality

My daughter is American by birth, but the father is Chinese (national) can he take her in China???

Hi
Long story short :

I have an 8 year old half chinese daughter...her father is Chinese and lives in China. She was born to me in the USA. Her father and I are on very bad terms and never speak. He does not have any relationship with her.

I want to go to China to teach English. My question is : Could he take her from me??? Being in China and he being her father, etc.

Do you get married and have marriage certificate? If yes, the father can take her in China. If no, it may be hard and complicated.

Yes, we were married but I annulled in in America. He has since remarried in China

He cannot take your daughter from you if you have got the custody.Don't be over-worried about this.

I'm concerned because I have custody of her by USA law, but China is not part of the Hague convention and does not have to obey US law

you have to call the US embassy or consulate in China the legal division. They should advice you on this correctly without any fees and also good to know their number and have their help in future to register with them.
