Wing, if your daughter overstays, she needs to pay the overstay fine first and then apply for an exit pass to go back to her own country. The fine is CNY500 each day and the maximum amount won’t be more than CNY10,000.

Firstly thanks to you Walt, for the answer. But the situation is she overstay for 1 years already. Is she just get fined penalty only and can go out from PRC like that?

Wing, for those under serious cases, they may be detained too. But if she reports her situation and apology for her overstay genuinely, I don’t think she will be detained. She can just pay the fine and apply for exit pass to leave PRC.

hi. my daughter overstayed in PRC by about 1 month. There was a special office we had to go to and pay the fine, get yelled at, and so on. We had to go about three times in total. But that was it. Because the situation was out of your hands, the police will probably be more kind to you. What city are you in? In Beijing there is a special office just for overstays of foreigners, it is by Ritan Park. But yes, we just paid the overstay apologized and cleared it up basically. But where are you from and where is your daughter from? I am confused.
