About:Adopt Chinese Children

adopt our niece

we wish to adopt our niece. We are married and reside in Australia. I am Australian citizen and my wife is Chinese with permanent residency. Both the child's parents wish for this to happen. They already have one daughter and the second child is also a daughter.( yet to be born ) The husband wishes to have a son. We cannot have a child.

Peter, I am afraid that you may not be able to adopt your niece. The law requires that the adoptees refer to kids who lost their parents when they were younger than 14 or were abandoned by their parents. If parents are unable to raise their kids, their kids can become the adoptees. Here "incapble parents" refer to those who suffer from serious illnesses or handicapped.

Therefore, I don't think your niece meets the requirements.
