Police Clearance / Certificate of no criminal conviction

hi, I'm going to migrate to the US under fiancee visa. As part of the requirements, I need to submit police clearance or certificate of no criminal conviction to those countries i had worked or stayed for 12 months or more. I worked in China for 2 years. I had Z type. Chinese embassy advised me to get it in Shenzhen PSB. I called my boss in PRC. He went to the PSB to check, he said he was told that i need to personally apply for it. I'm wondering if there is any other way.

My problem is: On my second year of Z type, I was caught having a part time teaching job at night, after office hours. I was charged of "illegal employment" since I worked outside the provisions of my legit job. My boss who sponsored the Z type told the police that they allowed me to do so since it was after office hours. However, police said that it is not allowed so I paid 1,000 Rmb and was given a warning. My company who sponsored the Z type did not pay any penalty. However, come July 2013, I got a call from the police saying I have to go to the nearest police station. They took our passport again and said it's for investigation. Then later, they informed me that they have to cancel my Z type due to my previous case, they gave me 14 days to leave the country. I was never detained, did not pay the penalty again, did not escorted to the immigration. I was told that I can apply for another visa because I am not blacklisted.

My question is: since I have to get that certificate, will I be able to get that if I will go to PRC considering my previous case? Second, will they indicate that in the said certificate? I've seen the sample certificate. It says "No Criminal conviction." Third, is it safe to travel back to PRC having that previous case? I'm confused if "illegal employment" is a crime in PRC.

Please help.

Hi, don't worry. It's not a big deal. Anyway, the deed is not considered as a criminal penalty. Instead, it's an administrative penalty. So I think you are able to get the non-criminal record. I don't think they will reflect the illegal work you have done in the past on the certificate. It's safe to travel back to PRC. Relax!
