About:Visa Application for Children Born in US with Chinese Parents

US citizen, Chinese Wife and son born USA with passport applying for China Visa

Hello,

I'm currently going through a travel agency in San Francisco to obtain my tickets and China entry permit for my upcoming trip to China early next year. The travel agent had informed me my son's request was denied because he was born when my wife didn't receive her permanent resident yet.

So they told me my son can only apply for a travel permit. If this is the case we were told we have to apply for his travel permit in person at your offices. I want to confirm this before I travel out to San Francisco.

Frank, according to the laws, if your son is required to apply a travel permit, he is regarded as having Chinese nationality. Probably, the reason the agency tells is not real reason.

Since your son has USA passport, right? If so, he needs to apply for an ordinary visa. So you are suggested to consult the Chinese consulate in San Francisco directly before you go.

Thanks for the reply Robin. I got a email response from the consulate in SFO since i wasnt able to get ahold of them via phone. They said since my wife didnt receive her green card when he was born he has to apply for a travel permit instead of a China Visa.
The travel agent said we have to go there and apply for this in person. I am confirming this with the Chinese consulate in SFO.
Yes my son was born here in the states and has a US birth certificate and a US passport.
