You can provide a proof of your legal status in USA, right?
If so, you can try to apply in USA at the nearest consulate/embassy.

I have only my waiver (esta) which has been accepted. Will that be enough?

It can be used. Do you have any stamp/slip on your passport to show your last entry to USA? That will be used.

Yes, perfect! And do you know if it is still possible to pay an extra fee for a rush application? I will be in NY for only 3 working days.
