My wife has given birth in china and what can i do to make the baby live in china legally.

Hello, I'm on Z-visa and i invited my wife to join me on s1 visa and we have got resident permit for her. She had stayed with me a while and now given birth to a new baby boy. My problem is how or what can we do to make the little boy stay in china legally.
What should we do and what documents do we need for the baby. Should we go to the PSB office or my Embassy and what at all should we do. Thanks.

Hi, Zak, both of you and your wife are US citizens right?
If so, you need to report the your son's birth to US Embassy in China firt and then the embassy will issue your son a US passport and Consular Report of Birth Abroad (CRBA). These two documents are necessary for your child to leave China. After getting the passport, you need to apply for a visa (S1 type) for your son as soon as possible and for application, you need to contact the local PSB to apply.

For reporting your son's birth, you need to preare the following documents: birth certificate (English translation is not required), both of your passports, your marriage certificate, a recent taken 2 inches * 2 inches photo, application form (it can be found on your embassy website), mother's pregnancy and child's growth pictures, hospital records. Then you two can take all thoese documents and your son to your embassy to apply. If you still want to know more, you are suggested to search the website of USA Embassy in China.

You may get your son an exit permit to exit China, but not assured about whether you can get it inside China. I heard some people did so before, so you can try to apply.

You need to go to your embassy first to get a passport for your son and then go to the local PSB for consult the visa issue. You can also consult the officers in your embassy and I am sure they can help your son to stay in China legally.
