About:Visa Application for Children Born in US with Chinese Parents

Chinese father has baby born in US

My friend is Chinese citizen and had a baby in US from a surrogate. He plans to go back to China with his baby. The baby just received her US Passport and she is only 3 weeks old. We understand she doesn't need a Visa but needs travel documents. The situation is complicated because he is single father and his name only is on birth certificate. There is no mother listed on birth certificate. What documents does he need to return his daughter permenantly to China?

Dawn, she is already a US citizen if she has the US passport. Therefore, she has to apply for a visa if she wants to get back to China. I am afraid that he won't apply for the travel document successfully for his daughter. In order to apply for that travel documents, both parents' passports (original and copy versions), marriage cetificate and valid resident permit in the US are required. I don't think he can provide all these documents.

Visa's are for "temporary" stay in China for tourism, work, school, etc. This infant will be returning to China to live permanently. She is a US citizen but her father is Chinese and a Chinese citizen. He has never been a US resident and is only here on a temporary travel visa. The infant has NO mother listed on the birth certificate. The father has never been married and does not have a female partner. Also, it is his biological child and she is Chinese born via a US egg donor and surrogate.
