About:Visa Application for Children Born in US with Chinese Parents

Chinese Travel documents for my daughter?

I am an American, my wife is Chinese - before she got her greencard, our daughter was born. We are planning a visit to China and had a travel agent go to the consulate for us. The travel agent said that because my daughter was born before my wife had a greencard, then i needed to bring my daughter to the consulate in NY for travel documents. Is this so? I am an American citizen, my daughter was born here as an American citizen, we both have US passports - does she really need Chinese Travel documents because her mother didn't get her documents until after birth?

Hi, this is not true. If your daughter holds US passport, she needs to apply for a Chinese visa. Because only if both of parents are Chinese citizens and have no U.S. permanent resident card), the child shall apply for a Chinese travel document.

Thanks for the reply. That is what our agent attempted to explain this to the Chinese consulate. However, they didn't want to hear any of it. They said that because her mother got her greencard after our daughters birth that she needs Chinese Travel Papers. They said that the fact that I am American Citizen plays no role at all. Actually they said if we were both Chinese and I had at least a greencard, that my daughter would be eligible for the Visa... but since I am American and my wife is Chinese and my wife was not yet a permanent resident when my daughter was born they said my daughter need to travel on her mothers Chinese Passport via the Chinese Travel Document...

We were told that the only way she's going to be allowed in PRC is if we bring her to the consulate (4 hour drive each way for us) to get these so called "Chinese Travel Documents". I have real concerns about this - we have a trip in less than 3 weeks... I am not letting my daughter travel on Chinese Travel Documents as that would create possible problems exiting PRC. The agent said they tried to point out to the consulate that their own website has the rules - and the website says that if one of the parents is American citizen, and child was born here, then she can apply for it, if we were both Chinese with no permanent residence here, then we'd need these so called "Travel Documents" it seems like the consulate is enforcing the opposite rule!!!

My head is about to explode.

I think you'd better the Chinese embassy in the USA and listen what they say. If they give the same answer, I think there are not other choices. If the give different answer, then you may tell the consulate what you got from the embassy.

We got to the Embassy (my wife, my daughter and I). I showed them the printout of their site that clearly says that because I am an American, my daughter qualifies to travel on a visa. They refused to hear it. They said that because my wife received her greencard after our daughter was born, that my daughter would be considered Chinese for travel purposes and must apply for Chinese Travel Certificate. They once again said that if we were both Chinese and one of us had permanent residence here, then our daughter would be qualified for a visa instead. I kept pointing to the printout on their site - the supervisor came to explain that the stuff on their site is no longer valid information and that this new policy is now followed strictly. They stated that she will be both American and Chinese until her 18th birthday at which point she will have to make a choice...

In case anyone is interested - if you do apply for Travel Documents, you need 4 identical photos and parents original passports (so you can't apply for it for yourself until you finish the travel doc processing).

The embassy opens at 9 in NY, so be there by 8 or face the consequences... i was in line at 8:10 and we were 10th (on a wed). Five minutes later there was another 20 people behind us.

15 minutes before 9, security asked everyone to pull out their forms - they checked versions of forms. There were many people in line with the wrong forms (because their site still pointed to the wrong form from many of the pages) those people were told to go home and fill out the new form. No handwritten forms are accepted - no blank forms provided either. Chinese Travel documents forms are available (Chinese only) and can be filled by hand. (Will need 4 identical photos for Travel Docs) NY Con. will take photos for you (CASH ONLY, $8 for 4)

Make copies of everthing, but bring change with you, they will ask you for copies of random stuff you have with you $0.25 per page
