About:Chinese Embassy in Philippines

can my husband's employer reject giving us dependent visa?

My husband is having a hard time adjusting in his new work because of homesickness although hes been living there for more than six mos. Now, he wants me and our 20 mo old baby to stay with him in china. However, it seems that his employer doesn't want him to give us the requirements for dependent visa. In fact, his employer is also holding his FEC although from what I have read he should be the one holding it.
My husband told me that we could try going there as tourist then later ask his boss if we could have our visa changed to dependent visa.
What is the best thing to do?

His work is important for the provision of our needs so he cannot risk to get out of his work and of course also because he signed a contract.

the employer has the right to hold FEC.. we only hold our passport..but he can request to scan to have a copy of it.. if you will be here in China as tourist, you'll be only staying in 3 months..but u need to extend every month and you need to present bank statement each month..most importantly, it's hard to change the L-visa to dependent visa..not any more as their policy.. to get dependent visa, you really need the help of his employer for school documents.. as requirements to get visa notification issued by chinese foreign affairs.. etc.

Thank you Hilda.

The problem is his employer doesn't even want him to reproduce or scan his FEC. His friend told him he should have a copy of it. I hope he wont encounter a problem for not having it.

as for the dependent visa its sad to know that we'll have to wait for his approval.

But will there be any his problem with legalities if we go there as tourist and stay with him for about a month? will that still need his employer's approval?

thanks for all the help

when my mom came here in china as tourist, i gave her the scan copy of my FEC, my passport, and my invitation letter.. then in the philippines, she prepared her bank statement, round trip ticket, etc.. we extended her L visa twice to stay here in 3 months..we presented my bank statement here in china twice also..i also asked her to have a copy of those papers she submitted to chinese embassy (Phil.) to present in immigration if ever they would ask some questions.. and we didnt encounter any problem.. now, she will be coming here soon as my dependent visa..
