About:China Visa

My one year L-visa is valid, but I have stay past the 120 days for one stay in China, what's the penalty?

I like to know the potential penalty of a US citizen exceeded the maximum stay of 120 days in China with a validate one year L-Visa? I need to go back to USA tomorrow and I have stayed past the maximum 120 days in China of my multiplue entry one year L-Visa that is to expired in January 2012.

You will be fined at a rate of 500 RMB per day for overstaying, 5000 RMB at most. You will be issued a 10 days exit visa with star on your passport, you have to exit China during the 10 days. Now your L visa has expired because you stay past the maximum 120 days in China.

well.. here is my experience of my own maximum per stay problem. I went directly to the airport and dealt with the immigration office.
Problem:
I have a one year L-visa with a 120 days per stay visit. I stay past the 120 days by 6 weeks.
The immigation office gave me two options to solve this problem:
1) Stay in BJ, go to the entry-exit office to get a new visa for my late stay. Not sure if I have to pay an penalty for the new visa. That will take about 5 days and at a minimum the cost of a new visa. (I am qualify to get a one year visa with a one year stay in China). With this option, I have to change my return flight to USA until I get the new visa.
2) The visa laws allow 10 days grace period with NO penalty after the maximum stay. Thereafter, it is 500 per day with a maximum of 5000 RMB. No other penalty access. No jail time or lost of continued visa privilage.
I must say that the China immigration officers at the airport were all very curtious, no problem, just the facts. After I paid the 5000 RMB maximum fine, the immigration officer was very helpful to get me through security and customs.
This was a very expensive visa learned.. but that is life. Next time I will take a trip to Hong Kong, Singapore, etc. and get a new stay starting date for the 5000 RMB. ;-)
