About:Visa Application for Children Born in US with Chinese Parents

Chinese dad, American mom. Child born in US. Does she need VISA?

My granddaughter was born in the US. Her dad is Chinese and lives and works in China. Does the baby need a Visa? Also, what are the laws with regards to the baby's nationality once she's in China? Parents are not married. She is an American citizen but does Chinese law recognize that?

Elaine, as China does not recognize dual citizenship, so the child can only get one nationality. Her mother is an American, so she should have the US citizenship. Therefore, she needs to get a visa for China. And nothing changes after she enters China.

Ok, thank you.

I just want to double-check... so the Chinese government will recognize her as a U.S. citizen and when my daughter wants to return home to the states there should be no issues? I guess my major concern (I'm probably worrying for nothing) is suppose there is a custody dispute, can they make my grandbaby stay in China?

Yes, there should be no issues when she wants to return to US. As for custody dispute, it mainly depends on the baby’s parents. No need to worry!
