British Citizen Married to Bosnian and married in Singapore.

Hi, I have just relocated with work to Beijing. I have now received my resident permit and am planning to apply for my wife and daughters S1 visas. However, as my wife is not a UK citizen and has no residence status in UK (we have lived overseas since we married 10 years ago) we cannot apply in UK. She could go to Bosnia to apply but will take a long time.

Can we apply in China instead with her and daughter on toursit types? If we do, how and where do we get the marriage certificate legalised?

Tim, you can apply tourist types for them. However, I am not sure if you can help them change tourist types into S1 types without leaving. My suggestion is that you visit Beijing Entry and Exit Management Bureau to confirm this. If they insist that they should apply in their own countries, then they have no choice but getting back to Bosnia.

By the way, your marriage certificate is issued in Singapore. Therefore, you need to have it authenticated by Singaporean Foreign Affairs Bureau and then get it authenticated again by Chinese embassy in Singapore. Then you can use it in mainland. But it isn't so easy. You have to translate it by qualified translation company and notarize it at local notary office before you send them to local entry and exit management bureau to change S1 into long term resident permit.

Thanks so even if we get S1 then we still need to autheticate the marriage and birth certificate? Thanks Tim

Tim, if your wife and your daughter already acquire S1, then they needn't translate and authenticate marriage certificate and and birth certificate (for your daughter) when they change S1 into resident permits. However, if they enter with tourist types and then want to change L into S1, then the above mentioned documents should be authenticated and notarized.

According to what I know, many local entry and exit management bureaus don't allow foreigners to change their entry permit types. That's why I suggest you should confirm this with Beijing entry and exit management bureau first before you ask them to apply for L types.
