Two visa/Residence permit in two passports?

Currently I am in China on a Q2. Previously I had a Residence Permit (married to Chinese National), which was in the 2nd passport. Can I apply for another residence permit using this older passport (still valid for over two years), whilst I have a Q2 in the other passport (both passports are from the same country in my name).
Thanks

Max, how long is your Q2 valid for? I believe it should be less than 180 days. If so, you don’t need to apply for the residence permit.

If you want to apply for it, you should use the passport with which you entered China.

Thanks May,

so you think I can only use one passport for Resident Permit and/or Q type. Is it illegal to have two passports from the same country, that are both valid at the same time?

How about getting a resident permit now? I have already entered China on the Q2 type(valid 90 days for each entry over one year). Can I do this?

Yes, if your passports are ordinary ones, it's illegal to use two passports from the same country in PRC.

You don't need to get the residence permit actually.

Max, I guess that you entered with the passport that has Q2 type, right? If so, you can’t apply for another residence permit with your older passport. According to the entry and exit management bureau, the applicants need to use the passports they entered to apply for extension or change their entry permit into temporary resident permit.

Usually, you will have an entry stamp on your passport when you entered. If you didn’t enter with your older passport, you shouldn’t have had the entry stamp. This stamp is your entry record. If you bring your older passport (without entry record) to the bureau, they can easily figure out you have another passport or you entered illegally. Under this circumstance, do you think they will approve your application?

Second, according to my knowledge, Q2 type can’t be changed into a temporary resident permit. So you can’t change it into a resident permit at local entry and exit bureau.

Lastly, I am curious how you can keep two valid passports. This is also the key to your question.

PS: the above is based on my personal knowledge. You can choose to accept it or not. If you have any doubt, you can visit local entry and exit mangement bureau for further consultation.
