About:China Visa Fees

Hi,
I am in shanghai and have overstayed my visa 3 years. I'm ready to turn myself into the psb I have the 5000 rmb penalty fee, all I want is to go home. Is there anything I can do or say that can help me stay out of detention and get me home as soon as possible? I have the money for the plane ticket.

Do not worry. I was at PSB last week. There were a lot of people who overstayed for 3 or more years. Detention Center or Jail? It depends. Some Overstayers do have criminal records in China, If, they will put into a Detention Center or maybe Jail for sure. A lot of overstayers were not able to pay for visa and do not have money for the fine, the exit-visa and the flight. They maybe will end in a Detention Center until things sorted out. But if you are not a criminal ( overstaying is not a crime in china ), and if it is your first overstay and you do have the money, you will have to leave in 10 days after you visited the PSB. Prepare the temp-residence paper - it is a must have - pay the fine - do not lie at the PSB - feel sorry and shot it - handover your mobilenumber and they will call you after 5 or 6 days to pick up the exit visa and after that...Goodby China - and please do not overstay again.

Hi, an update.. I went to PSB and was sent to police station because my temporary residence was incorrect. Spent several hours there making my statement and getting new temp residency paper. The police were very nice, but after I signed the papers and told them I could pay penalty and buy a ticket. They still asked me to return to police station tomorrow, so they can tell me my penalty. Is this normal? Seems a unusual, and has me quite worried. Any advice?

Generally, you will be given a 10 days visa to leave China after you pay the penalty. Detention may not be possible.

I've heard from someone while waiting in line at the lama temple PSB that he knew someone who overstayed 1 year, after turning himself in he had to do something like 30 days in jail or something. But then again, your face might be prettier than his, so you just might just luck out and do no time. It's all on the mood of the officer doing your paperwork. If he/she had a great weekend, you probably won't do anytime, but if that officer had a rough weekend or like usual, a busy week, you might have to spend sometime in jail. I really hope for the first one as I really don't know what is going to happen to me. In your situation, I would take any advantage I can get. I would definitely go in on Mondays as officers are usually refreshed from the weekend. Another thing is as a woman, you should look for a male officer as they are more likely to feel some sympathy for you whereas a female officer won't feel as much sympathy. Don't forget to look down as they will look at you as they are inputting your information in. Also write an apology letter to the PSB with maybe an explanation why you haven't taken care of this before. Another thing is that if they tell you to wait, or to come back later, don't leave and stand or sit in there view as it will cause them to think about you and feel some sorrow for you and will help with your verdict. You also need a temp residence permit as Shanghai visa office can only offer visas to people in Shanghai. Read my story below on how I did it. Remember, they have the power to do anything they want to you as you have overstayed for 3 YEARS!!! Bring everything into the PSB and wish for the best as I am going to tomorrow. Do not worry. Keep friendly. Buy a ticket, prepare the 5000 RMB fine and everything will be fine I think. May they will let you again sit for several hours, but its still better than in jail, or?

Notice: Try to buy a ticket you can change as you may not know when you are allewed to go. After you receive the temp-resident paper ( by the way - what was wrong with yours - old one - you moved into another apartment? ) you have to go for the Exit Visa which will normaly take 5 to 6 days...so better if you are able to change flight if dparture date is to early.
