the regulations vary from place to place in China, but 3 years overstay is too long, if you irritate the police or immigration office, you will be put into prision because its your fault, however, if you are lucky to surrender yourself to a kind police, apologize for your fault and pay for the penalty, maybe you won't be put into jail.

Hello sir, How about 10months over stayed in China? Do I need to pay a penalty or only stay in the jail? I don't have any savings or money, how about my plane tickets going home?
