About:Overstaying in China & Penalty

Passport taken away

Hi my husband has a 5 year visa for China as he works there. He hasn’r Been able to exit the country, as his flights are constantly cancelled. He has followed the rules and had visa extensions. However, Immigration have now taken his passport and told him to report to them in 3 weeks with a huge amount of documents and paperwork. He has explained he is desperate to leave but they are being very uncooperative and refuse to explain why they have taken his passport.

Sorry I should also add, that even though he has a 5 year visa, he is still required to exit the country every 90 days.

Dear, may I ask what type of visa your husband holds? Is it an M visa or Z visa?

He can apply for a stay permit. I have a 10year M visa and have been getting a new 30 day stay permit every 30days. It's not that much paperwork and cheap to do. And you keep your visa. If he is still denied, he can enter Hongkong via shenzhen bay, but cannot fly into hong kong. Do the 14 day quarantine and fly out of hong kong.

His company should be able to help with getting his passport back, but I'm starting to think the reason they took his passport is because of the 182 day rule. has he been in china over 182 days this year when they took his passport? Only Z visa and residence visa holders can stay over 182 days in china I believe. If its M visa, they probably want to make sure he is actually working "with" a company here, and not "for" and company here in china as he would be subject to china taxes.
